Here is the updated Use Of Force and Use Of Deadly Force for Self Protection in the State Of Delaware.

While the exact language of “Self Defense” is not used, the meaning of the words and phrases that they do use  in Delaware Self Defense laws such as “Self Protection” certainly carry the same meaning. So Delaware’s Self Defense Laws are actually called a “Use Of Force & Deadly Force Laws”.

The Law is below:

11 Del. C. 1953, § 463; 58 Del. Laws, c. 497, § 1.;

§ 464 Justification — Use of force in self-protection.

(a) The use of force upon or toward another person is justifiable when the defendant believes that such force is immediately necessary for the purpose of protecting the defendant against the use of unlawful force by the other person on the present occasion.

(b) Except as otherwise provided in subsections (d) and (e) of this section, a person employing protective force may estimate the necessity thereof under the circumstances as the person believes them to be when the force is used, without retreating, surrendering possession, doing any other act which the person has no legal duty to do or abstaining from any lawful action.

(c) The use of deadly force is justifiable under this section if the defendant believes that such force is necessary to protect the defendant against death, serious physical injury, kidnapping or sexual intercourse compelled by force or threat.

(d) The use of force is not justifiable under this section to resist an arrest which the defendant knows or should know is being made by a peace officer, whether or not the arrest is lawful.

(e) The use of deadly force is not justifiable under this section if:

(1) The defendant, with the purpose of causing death or serious physical injury, provoked the use of force against the defendant in the same encounter; or

(2) The defendant knows that the necessity of using deadly force can be avoided with complete safety by retreating, by surrendering possession of a thing to a person asserting a claim of right thereto or by complying with a demand that the defendant abstain from performing an act which the defendant is not legally obligated to perform except that:

a. The defendant is not obliged to retreat in or from the defendant’s dwelling; and

b. The defendant is not obliged to retreat in or from the defendant’s place of work, unless the defendant was the initial aggressor; and

c. A public officer justified in using force in the performance of the officer’s duties, or a person justified in using force in assisting an officer or a person justified in using force in making an arrest or preventing an escape, need not desist from efforts to perform the duty or make the arrest or prevent the escape because of resistance or threatened resistance by or on behalf of the person against whom the action is directed.

§ 465 Justification — Use of force for the protection of other persons.

(a) The use of force upon or toward the person of another is justifiable to protect a third person when:

(1) The defendant would have been justified under § 464 of this title in using such force to protect the defendant against the injury the defendant believes to be threatened to the person whom the defendant seeks to protect; and

(2) Under the circumstances as the defendant believes them to be, the person whom the defendant seeks to protect would have been justified in using such protective force; and

(3) The defendant believes that intervention is necessary for the protection of the other person.

(b) Although the defendant would have been obliged under § 464 of this title to retreat, to surrender the possession of a thing or to comply with a demand before using force in self-protection, there is no obligation to do so before using force for the protection of another person, unless the defendant knows that the defendant can thereby secure the complete safety of the other person.

(c) When the person whom the defendant seeks to protect would have been obliged under § 464 of this title to retreat, to surrender the possession of a thing or to comply with a demand if the person knew that the person could obtain complete safety by so doing, the defendant is obliged to try to cause the person to do so before using force in the person’s protection if the actor knows that complete safety can be secured in that way.

(d) Neither the defendant nor the person whom the defendant seeks to protect is obliged to retreat when in the other’s dwelling or place of work to any greater extent than in their own.

§ 466 Justification — Use of force for the protection of property.

(a) The use of force upon or toward the person of another is justifiable when the defendant believes that such force is immediately necessary:

(1) To prevent the commission of criminal trespass or burglary in a building or upon real property in the defendant’s possession or in the possession of another person for whose protection the defendant acts; or

(2) To prevent entry upon real property in the defendant’s possession or in the possession of another person for whose protection the defendant acts; or

(3) To prevent theft, criminal mischief or any trespassory taking of tangible, movable property in the defendant’s possession or in the possession of another person for whose protection the defendant acts.

(b) The defendant may in the circumstances named in subsection (a) of this section use such force as the defendant believes is necessary to protect the threatened property, provided that the defendant first requests the person against whom force is used to desist from interference with the property, unless the defendant believes that:

(1) Such a request would be useless; or

(2) It would be dangerous to the defendant or another person to make the request; or

(3) Substantial harm would be done to the physical condition of the property which is sought to be protected before the request could effectively be made.

(c) The use of deadly force for the protection of property is justifiable only if the defendant believes that:

(1) The person against whom the force is used is attempting to dispossess the defendant of the defendant’s dwelling otherwise than under a claim of right to its possession; or

(2) The person against whom the deadly force is used is attempting to commit arson, burglary, robbery or felonious theft or property destruction and either:

a. Had employed or threatened deadly force against or in the presence of the defendant; or

b. Under the circumstances existing at the time, the defendant believed the use of force other than deadly force would expose the defendant, or another person in the defendant’s presence, to the reasonable likelihood of serious physical injury.

(d) Where a person has used force for the protection of property and has not been convicted for any crime or offense connected with that use of force, such person shall not be liable for damages or be otherwise civilly liable to the one against whom such force was used.

7 Week Self Defense Camp Delaware That Rival’s Navy Seals

Ok those are big words but let me quantify. Recently I finished a 7 Week SFA Ccamp with creator Allen J. Sachetti where we trained on Saturday’s for 6 hours (broke into two 3 hour sessions) in 7 different Threat Scenarios.

In fact this 7 Week Self Defense Camp Delaware is the kind of training that Mr. Sachetti has done in the past for Navy Seals, Marines, Army and other Military around the world. What made it different is that this was being done for civilians and it was being done to EXCELLENCE.

In 7 Week Self Defense Camp Delaware you go through 7 Threat Solutions:

#1 – Single Attacker Striking – now this is comprehensive where you learn how to deal with real full force strikes from standing in 3 ranges and then at what he calls Depth from kneeling, sitting and laying with someone stomping on you!! He takes you into the threat and then develops your Instinctive Mind (while you are in the frey) with AMAZING TECHNIQUES that really destroy the attack and then the attacker!!

#2 – Single Attacker Grappling – think of a World Class Wrestler trying to press you with a Greco Roman Clinch or Level Change and Drive in with a Shoot!! That is what we were trained for and in 6 hours, yes 6 hours we could destroy these types of attacks even from very good wrestlers.

#3 – Single Attacker Ground – Here SFA gave me something so much more than BJJ, it gave me the good positions, controls & escapes but showed me how to use my teeth and claws to really destroy a good BJJ guy’s game and dominate him with something that he is completely unable to deal with.

#4 – Single Attacker Knife – Empty Hand Vs. Knife is certainly a big challenge but what we were shown clearly gave us the best chances. Then we went into using the Knife offensively ourselves. We got more than most Military know about this!!

#5 – Single Attacker Pistol – THIS WAS COOL, you learn how to stop the gun from being drawn, take it way as he does and really how to deal with it when the attacker has the gun out and in your face!!

#6 – Multiple Attackers Striking – Ok imagine 3 guys mercilously pounding on you, because that was it. Then once you are in that environment Mr. Sachetti shows you how you can counter the blows coming in and mount an effective offense from there to stop and disable one at a time as you get up. VERY COOL>

#7 – Multiple Attackers Restraining – Mr. Sachetti is the only Instructor I know who is working in this area. We started with 2 people holding us, first standing and then on the ground. Believe it or not the ground was easier. This certainly is tough but SFA has really effective techniques that you can do to destroy this threat as well. I was amazed how good I was able to get in 6 hours on this.

Ok so I quantify my statement. In 7 Weeks training 6 hours each Saturday I honestly can say that you develop a greater skill in these 7 areas than most Military Special Forces do. Keep in mind too most military special forces are training to Move, Shoot & Communicate. They work more with their speciality.

Self Defense For Women – The Best Self Defense 7 week SFA Camp

Ladies I just finished a 7 week SFA Camp – The Best Self Defense For Women  and let me tell you something, SFA WORKS!!!!!

I was able to develop a confidence and ability to really effectively STOP & DISABLE Larger, Stronger Men from Striking me, trying to grab me or hold me on the Ground!! Then I got good too against a man with a knife or pistol up close. That was tougher but again the SFA Methods used by Allen J. Sachetti REALLY WORK.

SFA is the Survival Fighting Axiom and it was created by Mr. Allen J. Sachetti who is a World Class Fighter that studied many Martial Arts over the years. He also worked as a Bail Agent for 11 Years, A Body Guard, A Close Quarters Combat Instructor for the U.S. & Other Military and was a Private Paramilitary Security in South East Asia.

Mr. Sachetti shows us the difference between a Martial Arts class and SFA. In a Martial Arts class you go each time and learn the A, B, C’s of that art as move along in that curriculum. That’s ok to kind of learn ideas and technique, but in SFA you start by looking at the THREAT. Experiencing what it is like to actually be in different attacks and then you are fed the technique and reactions as you are in the Threat.

THIS IS VERY DIFFERENT. Not to mention SFA techniques are also a lot different than Krav Maga or Karate. They are like nothing else I have seen before and THEY ARE EFFECTIVE.

So I was going through this camp, each time being put in another threat and at first I have to tell you that I was scared. My mind was racing and it was hairy, but you now what that passed in only a few sessions. It’s kind of like I was swimming and got used to the water.

Then Mr. Sachetti started perfecting my technique and reactions as I was in the Threat Experience. I will give him credit, that was hard to do for him, especially for somebody who had never done anything before like me, but he patiently worked each day with over and over again until I got it.

Guys hitting me, trying to take me down, hitting me on the ground or trying to hold me there. All of it was covered until I COULD PERFORM.

Then we worked with the Knife, man that was different. Again nothing like Krav Maga, you never grabbed or tried to block the Knife, no sir!! That stupid stuff will get you killed, but Mr. Sachetti has a way of reacting to Direct The Blade, you guide it or move it and use the energy of each attack to stop and disable the killer who is trying to slice you in half. This definitely is worth the time.

The Pistol in the face was also a rude awakening. DAMN!! All I can say, but soon I was doing that too WITH NO FEAR. You see if the guy wants to shoot you he will, so if he is holding the gun on you and has not shot he does not want you dead, he wants your compliance.

As soon as you understand that you can move to execute really good techniques that take this gun away from him. EVEN ON THE BIG GUYS!! I can tell you I am only a 115 lb woman but I could do it on guys 200 and up!!

It took me a bit longer but following SFA always led me to success. Now SFA is part of my life and I will NOT leave home without it.

Self Defense – The Most Important Thing that Need to be Addressed

The best techniques for Self Defense

There are many Martial Arts, Combat Sports, Fighting Methods and Training Systems out there all trying to profess that they have the best techniques for Self Defense and that they will work in real life situations.

However there is one aspect of Self Defense and in fact the most important aspect that none of them address. This aspect

Most people can execute or imagine techniques to be performed in a variety of situations but “the Truth is that you cannot swim unless you are in the water”.

Delaware Self Defense Law Is a Use Of Deadly Force Law

In Delaware some have said that there is no delaware self defense law, well this is really arguing symantics because there most certainly is a Justification For The Use Of Deadly Force and The Use Of Force in Delaware by private citizens. Here is the law as it is written, Notice (c) in the Delaware Code:

§ 464. Justification — Use of force in self-protection.

(a) The use of force upon or toward another person is justifiable when the defendant believes that such force is immediately      necessary for the purpose of protecting the defendant against the use of unlawful force by the other person on the present      occasion.

(b) Except as otherwise provided in subsections (d) and (e) of this section, a person employing protective force may estimate      the necessity thereof under the circumstances as the person believes them to be when the force is used, without retreating,      surrendering possession, doing any other act which the person has no legal duty to do or abstaining from any lawful action.

Surviving & Overcoming A Real Street Attack

Just Yesterday one of my students came to me with a very upsetting story. Apparently he was in a McDonalds with his wife and 3 children. His wife and 2 daughters had entered the McDonalds but he and his little son were outside.

There was a walk way for pedestrians that went across the circular drive through and his little boy only 7 and very short starting walking to the door. As he did a maniac in a truck started BACKING UP in the drive through at about 25 miles a hour!!

My student had to scream, stop, stop and THROW HIS BODY between his son and the oncoming truck. This person stopped with only inches to spar his son’s life. PRAISE GOD FOR THAT.

Then this person got out of the truck to actually complain to my student, he asked in a very angry tone “Whats going on” and my student replied “You almost killed my son!!”, to this the person said “Well your son should’nt have been there” and made a threatening posture towards my student.

HUMAN ANIMALS like this moron who have no remorse in hurting the most innocent child are out there. They are indeed cowards so when they attack they will attack because they feel they have an advantage.

YOU MUST QUICKLY REVEAL TO THEM THEY DO NOT. Obviously my student could have made a case for fearing for his life and defended himself but he was able to walk away as this coward proceeded to SLANDER HIM even more. If however this punk had pursued him into the store he then would have had to react.

My student was blessed this time and may I say to his credit he even prayed for this person after such a shamless act. I know God will bless him for that.

Yet we have to remember that these souless fools are out there and sometimes we will not have the option to walk away. Another student of mine (who was new and not yet trained) a young lady in our local High School was walking out of school when this animal (another girl) grabbed her by the hair from behind and proceeded to beat her over and over again FILIMING IT FOR YOU TUBE!!

This young girl took several shots to the head and because she was not yet trained in how to react when someone grabs you by the hair, she did not know how to deal with the situation. After the beating this young girl was terribly shamed and the coward who attacked her from behind posted everything on you tube like she was some hero. I am sad to say that the young lady who was the victim did not ever go back to that school as she was not encouraged to deal with the negative slander to face this person and the event, but instead shut down terribly.

Her attacker was a heavy set girl with a lot of hate in her heart who was known for violence but her methods of attack where always the most cowardly seeking to grab a hold or strike a person when they were completely unaware.

The fact is that the young lady who was a victim really was capable of kicking this other girls butt, yet she never was encouraged to rise back up, get back on the horse and face this person.

Remember this, this is how cowards attack. They do not stand face to face often and if they do they will only attack if they feel an advantage or should I say a WEAKNESS. Train yourself now NEVER to show weakness, even it is a lie if it is perserved evil people will react with instinct to attack.

That’s right weakness, perceived or real will ignite the instinct of those who are truly evil with hearts filled with hate to attack. Remember that, so how do we train ourselves now not to project this?

I have dealt with evil people before too and I tried to give them the benefit of the doubt or even compassion but to their foolish eyes this was perceived only as weakness and it invited these cowards to become aggressive. Once doing so the REALITY of me quickly revealed to them they were wrong  but much conflict could have avoided if I had not given the wrong impression to begin with.

We are facing very bad times ahead, the dollar collasping, hyperinflation and there are people in our society who are really evil with an immense amount of hatred and malice in their hearts. So no matter how much Doomsday Prepping you do if you have not prepared your “Battle Sense”, “Warrior Instinct” & “Fight Drive” you will be at a terrible loss, no matter what weapons or techniques you think you have.

The Fire Of The Fight is like nothing else. To experience the fury of a vile, hate filled, human animal baragging you over and over again from a position of advantage or even hurting your children. Remember cowards are more dangerous than Brave Men. Brave men have honor, cowards do not. They attack only from behind, unseen or when they think they have a distinct advantage, even to hurt children.

Do Christians Have The Right To Defend Themselves

The short answer is YES, there are many, many scriptures which speak of this. Of course our main purpose is to Love and Spread The Truth but if we or our loved ones are being directly threatened of course instinctively and immediately we have the right to defend ourselves.

“Blessed Be The Lord My Rock Who Trains My Hands For War My Fingers For Battle” – Psalm 144

This speaks of war of course but there are also many scriptures that speak about not allowing people to harm you or your loved ones and that in fact it is your duty to defend yourself.

Surely being confronted by a vile, evil human being who has no regard for you whatsoever and has no relunctance in attempting to harm you is a very bad experience. You cannot hesitate in this situation to defend your life.

As Christians truly there is nothing better than having Christ in our heart, walking in love, walking in faith and then to face people who are hu.man animals is a hard thing. So what does Christ say? I am going to pray about this more and make a post later.

If You Prep Food, Water & Ammo – Don’t Forget Instinct, Will & Drive

Watching Doomsday Preppers on Nat Geo I always see people prepping with Food, Water, Ammo, Medical stuff ect. but there is no one providing the avid Prepper a proper Self Defense Prep.

The Survival Fighting Axiom means the “Truth Of What Works” in Real Fighting and the first thing it cultivates in you is Proper INSTINCT, WILL & DRIVE. Each of these are actually different and SFA enables these important attributes very well.

Instinct – is your reactions at the moment of the attack. Will are your decisions during the attack or in spite of the attack. Drive is your Spirit to continue before, during and after the attack. SFA cultivates them all.

You see without these 3 attributes not amount of technique or coniditioning will enable a person to truly prevail in a life threatening situation. The worse thing is so many people think they already have them, in fact the person shouting the loudest about how tough he or she is or how much drive they have is usually the one with the least.

The fact is that Instinct, Will and Drive need to be nutured and cultivated like anything else and if you are not spending time doing this, then you won’t be ready when your family needs you or you won’t be as ready and that can be just as worse.

The bottom line is overcoming your attacker, winning, surpressing him and stopping his or her evil assault completely to eliminate any threat to you or your family in the middle of the Fire.
